Terms and Conditions

These Terms and Conditions govern your use of the Walsall Adolescent Healthy Weight Service (the “Service”). By registering for or using the Service, you agree to comply with these Terms. Please read them carefully. If you do not agree, do not use the Service.

1. About the Service

  • The Service is a free, healthy weight support program for young people (aged 12-19) in Walsall and their families.
  • It is fully funded by public health resources and provided at no cost to eligible participants. There is no subscription fee or payment required.
  • The Service is delivered through Gro Health’s online platform (provided by DDM Health Ltd) and/or in-person group sessions. It offers educational content, meal plans, workouts, and support related to nutrition, physical activity, sleep, stress, and wellbeing.

2. Eligibility and Registration

  • Who can join: Young people aged 12-19 who live (or attend school/college) in Walsall. Parents or carers of eligible youth can also participate.
  • Registration: Participants (with a parent/guardian for those under 18) must register through the official referral form. You will receive confirmation and access once eligibility is confirmed. Access lasts 12 months from activation.
  • Consent: A parent or legal guardian must consent for any participant under 18. By registering, you confirm that you have this consent.
  • Free Access: The Service is offered free of charge. We do not require any payment or subscription. There are no hidden costs or premium upgrades.

3. Use of the Service

  • Account Security: You may be given login details to access the platform. Keep your username and password confidential and do not share them. If you suspect any unauthorized use of your account, contact support immediately.
  • Personal Use Only: The materials and resources provided are for your personal and family’s use to support your health. You agree not to copy, share, or distribute the content for commercial or other non-personal purposes without permission.
  • Providing Information: You should provide accurate, current information about yourself (and your child) during registration and while using the Service. Inaccurate information may affect the advice and content you receive.

4. Health Advice and Medical Disclaimer

  • The Service offers general advice on healthy living. It is not a substitute for professional medical advice or treatment.
  • Always consult a qualified healthcare professional (for example, your GP, nurse, or dietitian) before making significant changes to diet, exercise, or lifestyle, especially if you have any health conditions.
  • If you are on any medication or have a medical condition (e.g., diabetes, heart disease, etc.), you must speak with your doctor or healthcare provider before starting the program or changing your diet/exercise routine.
  • Follow the guidance of health professionals and keep them informed of any progress or concerns. The Service does not provide personalized medical diagnoses or prescriptions.

5. Privacy and Data Protection

  • Your Data: We collect personal and health-related information (e.g. age, height, weight, dietary preferences, medical history) to tailor the program to your needs. This data is necessary to personalize your experience and track progress.
  • Privacy Policy: We handle your information in accordance with our Privacy Policy. All personal data is kept secure and confidential.
  • Data Sharing: We will not share your personal data with third parties except in limited circumstances, such as:
    • Providing the Service: We may share information with our support staff or technology providers strictly to deliver the Service.
    • Legal Requirements: If required by law or a court order (for example, NHS requests).
    • Child Protection/Safeguarding: If we have reasonable concern that a child or young person is at risk of harm, abuse, neglect, or serious safety issues, we are legally obliged to share relevant information with appropriate agencies (such as social services, the police, or NHS child protection teams). In such cases, we will take care to share only what is necessary to ensure safety. We will normally inform you and your parent/carer about this disclosure unless doing so would increase the risk to anyone’s safety.
  • Consent to Use Data: By registering for the Service, you (and your parent/guardian) agree to the collection and use of your information as described above.

6. Participant Conduct

  • Respectful Use: While using the Service or attending sessions, all participants and families must behave respectfully. Harassment, bullying, or inappropriate use of the platform is not allowed.
  • Prohibited Actions: You agree not to misuse the Service (for example, do not attempt to hack the platform, post offensive content, or share your login with others).
  • Consequences: We reserve the right to suspend or terminate access to the Service for any user who violates these Terms, at our discretion.

7. Intellectual Property

  • All materials, content, and resources provided through the Service (including text, graphics, videos, and software) are owned by DDM Health Ltd or its licensors and are protected by copyright and other intellectual property laws.
  • You are granted a limited licence to use these materials for your personal and family’s benefit during your participation. You may print or download content for your own use, provided you do not alter it or remove any copyright or trademark notices.
  • Any other use, copying, or distribution of the content is prohibited without prior written permission from DDM Health Ltd.

8. Changes to Terms

  • We may update or modify these Terms from time to time to reflect changes in the Service or legal requirements.
  • If we make significant changes, we will notify registered users (for example, by email). Continued use of the Service after changes are implemented means you accept the updated Terms.

9. Liability

  • No Guarantees: We aim to provide helpful and accurate information, but we cannot guarantee specific results (such as a certain amount of weight loss). Every individual’s situation is different.
  • Limitation of Liability: To the fullest extent permitted by law, DDM Health Ltd (Gro Health) shall not be liable for any indirect, incidental, or consequential loss or damage arising from your use of the Service.
  • No Responsibility for Harm: We are not liable for any injury, health issue, or damages resulting from following the general advice in the program. Always follow the personalized advice of your healthcare providers.
  • Legal Exceptions: Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for any liability that cannot legally be excluded.
